Review of the ID Card procedures

As per MSDC Circular 03/2014 as from today (17/03/2014), the need for the FOI applicant’s copy of ID card is no longer necessary for the request to be considered a valid request. It is to be considered that since the spirit of the FOI Act is that any document released under the Act is released to the public, all requests that are not subject specific may be processed without the need of ensuring that the applicant submitted a copy of the ID card or residence permit. However, it is to be noted that whenever a Public Authoritiy deems that it requires proof that the request can only be released to the subject or the subject’s representatives, Public Authorities are still empowered to request additional documention to ensure the identity of the applicant or to prove the connection with the subject – while ensuring that no additional personal data or documentation are requested beyond what is necessary to comply with Data Protection procedures.

Review of the extented timeframe according to Article 11 of the Freedom Of Information Act

The implementation of processing of FOI requests, so far, has allowed public authorities to extend the original 20 working day by an additional 40 days, which bring this to a total of 60 working days. Through a decision made by the IDPC, dated 27th February 2015, this interpretation is being revised in such a way that the extension that the public authority may avail of, shall be of up to a maximum period of 40 working days from when the original request was received, and this regardless of when, within the original 20 working day window, the authority informs the applicant of the need for an extension.
